For foreign investors and visitors that owe taxes, but are not eligible to receive a Social Security Number, Individual Taxpayer Identification numbers were created. Recent scrutiny has focused on ITINs as many undocumented immigrants were able to get Individual Taxpayer ID Numbers. Undocumented immigrants can legally file taxes in the United States with ITINs, even if their immigration status is not appropriate. Individual Taxpayer ID Number (ITIN), is a tax identification number issued by IRS (Internal Revenue Service). It is not connected to the USCIS (Social Security Administration) or the USCIS. The ITIN is issued only for tax purposes. The Individual Taxpayer Identification Number (ITIN), does not grant the right to live or work in the United States.

Application Requirements

The IRS issues ITINs for individuals who are unable to obtain a Social Security Number. An ITIN application is different from other U.S. government applications because the applicant’s immigration status cannot be verified and they don’t have to meet in person. The tax system does not validate the supporting documents. The IRS has its own rules and regulations and is not connected to the USCIS. An Individual Taxpayer Identification number can only be applied for by non-U.S. citizens. Individuals with a valid Social Security Number shouldn’t apply to an ITIN. It is not necessary and it is prohibited to have both a Social Security Number (also known as an ITIN) and a Social Security Number. An individual who has a valid Social Security Number (or Social Security Number ) should file taxes using that Social Security Number and not an ITIN.

The Advantages of Filing taxes and obtaining an Individual Taxpayer ID Number (ITIN).

  • A cash refund may be possible on your tax returns
  • You can show that you have lived in the United States.
  • The USCIS considers filing taxes “good moral character”.

  • Banks and mortgage companies can request tax returns when you apply for a loan
  • Taxes may be helpful in obtaining residency.
  • Some credit card companies and banks may allow you to open an account with an ITIN instead of a Social Security Number.
  • By obtaining an ITIN, you are building a credit history and filing taxes
  • If the U.S. government approves the Immigration Amnesty, filing taxes with an ITIN will help you apply for legal immigration status.
